Strict Rules of Gratification at KFTD as Bribery and Corruption Prevention

The act of giving someone, such as officials, public officers, or workers, diverse kinds of gift forms related to their working position refers to gratification. Gratification seems like a normal and nice gesture, yet it is actually part of corruption. 

It’s tremendously difficult to fight this malicious practice in any business. Hence, in response to that fact, PT Kimia Farma Trading & Distribution (KFTD) endeavors to prevent bribery within the company.  

 

Fundamental Principles to Respond to Gratification

Since gratification potentially induces bribery, conflict of interest, influences in objectivity, and corruption, Insan Kimia Farma Trading & Distribution should adhere to GCG and develop integrity. Therefore, it is crucial to be aware of the following principles. 

1. Prohibition to Offering and Demand of Gratification

Should any third party, explicitly and implicitly, request or offer entertainment, presents, or souvenirs, all Insan of Kimia Farma Trading and Distribution is forbidden to receive or allow it to happen. 

Kimia Farma Trading & Distribution also has defined a specific clause concerning the allowed type of gifts or presents. Thus, Insan KFTD should politely refuse any kind of offer, promise, or present that is not compliant with the regulations. 

2. Rules of Giving a Gratification

This principle forbids any Insan Kimia Farma Trading & Distribution to give presents, entertainment, or souvenirs to any third party, directly or indirectly, with the following consent. 

  • Getting any information or any matter prohibited by the law from the third party;
  • persuading someone to do so and so. 

Although gratification is prohibited, some types are allowed under conditions of specific boundaries, periods, due diligence, and rules. Some of the examples are as follows.

  • Hospitality service approved by the Unit Manager; 
  • CSR program in accordance with SOP and due diligence;
  • community and membership promotion, gimmick, reward, and
  • sponsorship. 

In fighting the risk of corruption through out-of-line gratification, Kimia Farma Trading & Distribution also assigns a specific unit called the Gratification Control Unit (Unit Pengendalian Gratifikasi).

If the type of forbidden gratification materializes, Insan KFTD, who refuses, receives, or requests it, must report using the reporting form set by Kimia Farma Trading & Distribution. Any Insan Kimia Farma Trading & Distribution (KFTD) who can not refuse requests or offers of gratification must also report this act.   

The above-mentioned rules stated a clear prohibition toward any form of gratification that may sway objectivity and drive to conflict of interest.  It also underscores KFTD’s commitment to maintaining integrity and transparency in its operations as a preventative of bribery and corruption, thereby fostering good governance practices.
